These Terms govern your use of the PeakSense desktop app ("PeakSense", "the App") and peaksense.net. By installing or using PeakSense you agree to them. How the App handles your data is described in the Privacy Policy.
You must be at least 13 years old. You must also meet the minimum age and other requirements of every platform you connect. If you use PeakSense for a business or on behalf of someone else, you confirm you're authorized to accept these Terms for them.
PeakSense is a Windows app that runs on your own computer. It finds highlight moments in your streams and turns them into short clips with captions and layouts, and it can publish those clips to the accounts you connect. It works with:
You connect platforms through their official sign-in (OAuth) pages. Connect only accounts you own or are authorized to manage. You can disconnect at any time in PeakSense, which also revokes PeakSense's access at that platform.
Your use of each platform remains subject to its own terms. By using PeakSense's YouTube features you agree to be bound by the YouTube Terms of Service. You also agree to follow, as applicable:
You keep all rights to your content. Use PeakSense only with content you own or have permission to use:
You're responsible for your clips and posts, including music, third-party material and anyone who appears in them, and for complying with each platform's rules on branded or paid content. If you connect Twitch, PeakSense keeps a local log of your stream's chat (usernames and messages) to find chat spikes. Treat it responsibly.
Don't use PeakSense to:
Manual posting: when you post from the editor, you review the clip, title and caption first. Instagram and Facebook Reels are posted publicly. For TikTok you also choose the privacy level and interaction settings (nothing is preselected), declare commercial content where it applies, and confirm before anything is sent.
Scheduled posting (PeakSense Pro): if you set posting days and times, you authorize PeakSense to upload clips from your posting queue to your connected account at those times.
Until PeakSense completes each platform's app review, posts may be restricted to private visibility by that platform, and each platform may limit how many posts can be made per day.
PeakSense stores videos and data on your computer (see the Privacy Policy). Depending on your settings, it may move full-length videos it created or copied to the Recycle Bin:
It may also replace an original with a 720p copy if you turn on shrinking. Pinned videos, files still being recorded and, unless you allow it, your own imported files are never removed automatically. Keep backups of anything you can't afford to lose; you're responsible for your storage settings.
PeakSense Pro is a one-time purchase that unlocks the Pro features for your own use. It includes future updates to PeakSense. Your licence key doesn't expire and is checked offline on your computer. It's personal and non-transferable: don't share, resell or publish it. Any purchase terms shown at checkout (price, taxes, refunds) are part of these Terms.
PeakSense relies on third-party platforms and software (for example YouTube, Twitch, TikTok, Instagram, Facebook, Kick, OBS Studio, Ollama and Hugging Face). We don't control them, and they may change or stop their services, APIs or policies at any time, which may affect PeakSense's features.
PeakSense is provided "as is" and "as available", without warranties of any kind, express or implied. We don't guarantee that it will be uninterrupted or error-free, or that detection, editing, recording, storage or publishing will meet your expectations.
To the fullest extent permitted by law, we're not liable for any indirect, incidental, special or consequential damages, or for lost data, lost content, lost profits or account actions by a platform, arising from your use of PeakSense. Our total liability for any claim is limited to the amount you paid for PeakSense Pro, if any. Some places don't allow these limits, so they apply only as far as the law allows.
You can stop using PeakSense at any time. Disconnect your accounts and delete its data as described on the Data deletion page. We may change or discontinue PeakSense at any time. We may also revoke a licence that was obtained or used in breach of these Terms.
We may update these Terms. Changes are posted here with a new "Last updated" date. Continuing to use PeakSense after an update means you accept the updated Terms.
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
